The scheduled reopening of the trial of those accused of murdering Ernest Manirumva, a Burundian human rights defender, is a positive step, said the East and Horn of Africa Human Rights Defenders Project (EHAHRDP) and Protection International today. The public hearing is expected to open at 9 am on Friday 30th March at the Tribunal de Grande Instance de la Mairie de Bujumbura.

Ernest Manirumva was vice-president of the Anti-Corruption and Economic Malpractice Observatory (OLUCOME). He was kidnapped from his home on the night of 8th April 2009 and murdered in the early hours of the morning of 9th April. Almost three years after his assassination, justice has still not been done. Serious questions have been raised as to whether investigations and the judicial process are meeting domestic and international standards.*

At the last hearing in the case on 15th June 2011, the Public Prosecutor’s office requested that the case file be returned to them for further investigations, as new information had been received. At the time, EHAHRDP and Protection International called for the new investigations to focus on previously ignored evidence and be carried out with due diligence. It remains to be seen whether impartial, independent and complete investigations, including interrogations, cross-examinations and DNA tests have been carried out on those individuals named by the Federal Bureau of Investigation (FBI) and 3rd Commission of Inquiry reports.

“We are waiting to see the results of investigations in the nine months since the last hearing,” said Hassan Shire, EHAHRDP Executive Director. “In order for justice to be done and to end impunity for attacks on human rights defenders in Burundi, all possible avenues must be impartially and independently investigated.”

“Ending impunity for the assassination of Ernest Manirumva is an opportunity for the Burundian judicial system to demonstrate both to civil society and human rights defenders that Burundi respects the rule of law,” said Luis Enrique Eguren, President at Protection International.

EHAHRDP and Protection International call on the Burundian authorities to ensure the protection of all witnesses in the investigation into Manirumva’s assassination and to guarantee the inviolability of judicial independence. Human rights defenders in Burundi have been threatened as a result of their campaign for justice. Our organisations request the authorities to guarantee the physical and psychological integrity of all Burundian human rights defenders, in line with the United Nations Declaration on Human Rights Defenders.

Burundi: La réouverture demain du procès sur le meurtre d’Ernest Manirumva est une opportunité pour la justice

La réouverture prévue du procès des personnes accusées du meurtre d’Ernest Manirumva, un défenseur des droits humains burundais, est une étape positive, ont déclaré le East and Horn of Africa Human Rights Defenders Project (EHAHRDP) et Protection International aujourd’hui. L’audience publique devrait ouvrir ses portes à 9 h ce vendredi 30 Mars au Tribunal de Grande Instance de la Mairie de Bujumbura.

Ernest Manirumva était vice-président de l’Observatoire de la lutte contre la corruption et les malversations économiques (OLUCOME). Il a été enlevé à son domicile dans la nuit du 8 avril 2009 et assassiné dans les premières heures de la matinée du 9 avril. Près de trois ans après son assassinat,  justice n’a pas encore été rendue. De sérieuses questions sont soulevées quant à savoir si les enquêtes et le processus judiciaire sont conformes aux normes nationales et internationales.*

Lors de la dernière audience le 15 Juin 2011, le bureau du ministère public a demandé que le dossier lui soit retourné pour poursuivre les investigations, après réception de nouvelles informations. À l’époque, EHAHRDP et Protection International avaient demandé que les nouvelles enquêtes se concentrent sur des preuves précédemment ignorées et soient réalisées avec la diligence voulue. Il reste à voir si des enquêtes impartiales, indépendantes et complètes, y compris les interrogatoires, contre-interrogatoires et des tests d’ADN ont été effectués sur les personnes nommées par le Federal Bureau of Investigation (FBI) et les rapports de la 3ème Commission d’enquête.

« Cela fait neuf mois que nous attendons de voir les résultats des enquêtes, depuis la dernière audience », a déclaré Hassan Shire, directeur exécutif du EHAHRDP. « Pour que justice soit faite et en finir avec l’impunité des attaques contre les défenseurs des droits humains au Burundi, toutes les pistes possibles doivent être investiguées de manière impartiale et indépendante. »

« En finir avec l’impunité de l’assassinat d’Ernest Manirumva est une occasion pour le système judiciaire burundais de démontrer à la société civile et aux défenseurs des droits humains que le Burundi devient un Etat de droit, » a dit Luis Enrique Eguren, président de Protection International.

EHAHRDP et Protection International appellent les autorités burundaises à assurer la protection de tous les témoins dans l’enquête sur l’assassinat de Manirumva et à garantir l’inviolabilité de l’indépendance judiciaire. Les défenseurs des droits humains au Burundi ont été menacés en raison de leur campagne pour la justice. Nos organisations demandent aux autorités de garantir l’intégrité physique et psychologique de tous les défenseurs burundais des droits humains, conformément à la Déclaration des Nations unies sur les défenseurs de 1998.
